In consideration of Texas Pastime Entertainment Inc. DBA Whatz-Up furnishing services and/or equipment to enable me or my minor child to participate in any and all activities at Whatz-Up to include but is not limited to go-karts, rock wall climbing, laser tag, kiddie cars, miniature golf, bumper cars, paintball, batting cages, arcade games, and any other amusement ride or device, I hereby agree as follows:

I fully understand and acknowledge that: (a) risks and dangers exist in my/my minor childs use of Whatz-Up equipment and my/my minor childs participation in activities at Whatz-Up; (b) my/my minor childs participation in such activities and/or use of such equipment may result in my/my minor childs death, illness, or injury including, but not limited to, bodily injury, disease, strains, sprains, fractures, partial and/or total paralysis, eye injuries, blindness, heat stroke, heart attack or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the owners, employees or agents of Whatz-Up, the negligence of me, my minor child or other participants, the negligence of non-participants, accidents, breaches of contract, the forces of nature or other causes; (d) these risks and dangers may arise from foreseeable or unforeseeable causes; and (e) by my/my minor childs participation in these activities and/or use of equipment. I hereby assume all risks and dangers of and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, employees or agents of Whatz-Up or by any other person, the forces of nature or any other causes whatsoever.

I, on behalf of myself/my minor child, my/my minor childs personal representatives, and my/my minor childs heirs, hereby voluntarily release, waive, discharge, hold harmless, and indemnify Texas Pastime Entertainment Inc DBA Whatz-Up, Waitgo Inc., and it owners, employees and agents from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my/my minor childs use of equipment or my/my minor childs participation in activities at Whatz-Up. I specifically understand that I am releasing, discharging and waiving any claims or actions that my/my minor child may have presently or may have in the future for negligent acts or other conduct by the owners, employees and agents of Whatz-Up.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AND, BY SIGNING IT, I AGREE THAT IT IS MY INTENTION TO EXEMPT AND RELIEVE WHATZ-UP FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE WHATSOEVER.
